By accessing or using EstatePilot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and EstatePilot ("we," "us," or "our").
EstatePilot is a software-as-a-service (SaaS) platform designed to assist licensed real estate professionals in the State of Texas with transaction management tasks, including but not limited to: document data extraction, form auto-population, electronic signature facilitation, and informational chat guidance. The Service is a tool to assist professionals and does not replace professional judgment, legal counsel, or regulatory compliance obligations.
The Service is intended for use by licensed real estate professionals, brokers, and their authorized staff. By using the Service, you represent that you are at least 18 years of age and are authorized to enter into this agreement. If you are using the Service on behalf of a brokerage or organization, you represent that you have the authority to bind that entity to these Terms.
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
The Service is offered on a subscription basis. After a 30-day free trial period, continued access requires a paid subscription. Subscription fees are billed monthly through our payment processor, Stripe. By subscribing, you authorize recurring charges to your designated payment method. You may cancel your subscription at any time through the billing portal; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
New users receive a 30-day free trial with full access to all features. No credit card is required to begin the trial. At the end of the trial period, access to the Service is suspended until a paid subscription is activated. Trial periods are limited to one per user/email address.

EstatePilot is not a law firm, does not provide legal advice, and is not a substitute for the advice of an attorney. The Service is a productivity tool designed to assist licensed real estate professionals with administrative and organizational tasks. Any information provided by the Service, including but not limited to the AI chat assistant, form auto-population, and data extraction, is for informational and convenience purposes only.
You are solely responsible for verifying the accuracy and completeness of all data, forms, and documents generated or processed through the Service before using them in any real estate transaction. The User bears full responsibility for all transaction-related decisions, regulatory compliance, and the accuracy of submitted documents.
The Service uses artificial intelligence to extract data from documents, auto-populate forms, and provide informational chat guidance. AI-generated output may contain errors, omissions, or inaccuracies. All AI-generated content should be reviewed and verified by the User before reliance or use. We make no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated content.
While the Service is designed to work with standard TREC and TAR forms used in Texas real estate transactions, we do not guarantee that forms populated through the Service meet all current regulatory requirements. Form standards, rules, and regulations are subject to change. The User is responsible for ensuring compliance with all applicable laws, regulations, and professional standards.
Electronic signature functionality is provided through integration with DocuSign, a third-party service. EstatePilot is not responsible for the legal validity, enforceability, or delivery of electronically signed documents. The User is responsible for ensuring that electronic signatures are used in compliance with applicable federal and state laws, including the Electronic Signatures in Global and National Commerce Act (ESIGN) and the Texas Uniform Electronic Transactions Act (UETA).
You agree not to use the Service to:
Violation of this policy may result in immediate suspension or termination of your account without refund.
The Service, including its software, design, features, documentation, and all related intellectual property, is owned by EstatePilot and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your active subscription.
Your Data: You retain all ownership rights to your transaction data, uploaded documents, and content you create within the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.
TREC and TAR form templates are the property of the Texas Real Estate Commission and the Texas Association of Realtors, respectively. EstatePilot's use of these forms is for the purpose of assisting licensed professionals and does not constitute endorsement by or affiliation with TREC or TAR.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ESTATEPILOT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:
OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless EstatePilot, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice, including but not limited to cases where:
Upon termination, your right to access the Service immediately ceases. You may request export of your data within 30 days of termination. After 30 days, your data may be permanently deleted.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Houston, Texas.
You agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration relating to any claim arising from these Terms or the Service.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a notice within the Service at least 30 days before they take effect. Your continued use of the Service after the effective date of any modification constitutes acceptance of the modified Terms.
